Unless explicitly stated otherwise, all content hosted on karvyforex.com is copyright Phillip Capital (India) Pvt. Ltd. (PCIPL), 2017. All rights are reserved. The copying, republication, or redistribution of PCIPL's copyrighted content including but not limited to, forum posts, reports, news mix, news comments, product lists, and data is explicitly prohibited without prior written consent.
The PCIPL database includes all data displayed on PCIPL's Live Markets, including research articles, market commentaries, AudioVideo files, knowledge base, and other assembled data. PCIPL database is a unique, creative, easilyidentifiable compilation requiring hundreds of manhours to compile and the copying, republication or redistribution of KFCL data, in part or in whole, is explicitly prohibited.
The information, products, solutions, and services ("Services") hosted on and from karvyforex.com are provided by Phillip Capital (India) Pvt. Ltd. (PCIPL), located at No. 1, 18th Floor, Urmi Estate, 95 Ganpatrao Kadam Marg, Lower Parel West, Mumbai 400013, Maharashtra, India. By using PCIPL's Services, users of the Services ("Users") are agreeing to all of the following terms.
Services Usage
Users must follow any policies made available to Users within the Services.
Users may not misuse Services. For example, Users are not permitted to interfere with Services or try to access them using a method other than the interface and the instructions that PCIPL provides. Users may use Services only as permitted.
PCIPL may suspend or stop providing Services to Users who do not comply with terms or policies, or if PCIPL is investigating suspected misconduct.
Using PCIPL's Services does not give Users any ownership of any intellectual property rights in the Services, or the content Users access. Users may not use content from PCIPL's Services unless Users obtain permission from its owner or are otherwise permitted. These terms do not grant Users the right to use any branding or logos used in PCIPL's Services.
PCIPL's Services are designed primarily for corporates involved in international trade and forex traders. Trading forex is potentially profitable for educated and experienced traders; however, there is considerable exposure to financial risk when trading forex. PCIPL makes no endorsement of forex trading, and does not intend to influence Users to trade or alter their trading approach. Phillip Capital (India) Pvt. Ltd. and its affiliates cannot be held liable for trading decisions based on information hosted on or from the PCIPL website.
PCIPL may email Users service announcements, administrative messages, and other information. Users may opt out of some of those communications by writing to PCIPL at fx@phillipcapital.in
Member Account
Users may need to obtain a member account ("Account") in order to use all Services.
Users are responsible for protecting their Account by keeping their password confidential. Users are responsible for the activity that happens on or through their Account. Users should not reuse their Account password on thirdparty applications. If Users learn of any unauthorized use of their password or Account, they should immediately contact PCIPL.
User-Generated Content
Some Services allow Users to submit existing content. Users retain ownership of any intellectual property rights that they hold in that content. What belongs to Users stays theirs.
When Users upload or otherwise submit content to PCIPL's Services, PCIPL does not use, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes), communicate, publish, publicly perform, publicly display and distribute such content. The rights Users grant in this license are completely secured. This license continues even if Users stop using PCIPL's Services.
PCIPL's Services display all the content that belongs to PCIPL. PCIPL may review content to determine whether it is illegal or violates PCIPL's policies, and PCIPL may remove or refuse to display content that PCIPL reasonably believe violates PCIPL's policies or the law. However, that does not necessarily mean that PCIPL reviews all content.
PCIPL responds to notices of alleged copyright infringement and terminates accounts of repeat infringers.
Modifying Services
PCIPL is constantly changing and improving Services. PCIPL may add or remove functionalities or features, and PCIPL may suspend or stop a Service altogether.
Users can stop using PCIPL's Services at any time. PCIPL may also stop providing Services to Users at any time, or add or create new limits to PCIPL's Services at any time.
Warranties and Disclaimers
PCIPL provides Services using a commercially reasonable level of skill and care. However, the following outlines things which PCIPL does not promise about the Services:
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER PCIPL NOR PCIPL'S AFFILIATES, SUPPLIERS, OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. PCIPL DOES NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET USERS NEEDS. PCIPL PROVIDES ALL SERVICES "AS IS."
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, PCIPL EXCLUDES ALL WARRANTIES.
Liability for Services
WHEN PERMITTED BY LAW, PCIPL, AND PCIPL'S AFFILIATES, SUPPLIERS, AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PCIPL, AND ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT USERS PAID PCIPL TO USE THE SERVICES (OR, IF PCIPL CHOOSES, TO SUPPLYING USERS THE SERVICES AGAIN).
IN ALL CASES, PCIPL, AND ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
Business Use
If Users are using Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify PCIPL and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.
About These Terms
These terms were last updated on May 10, 2017.
PCIPL may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to PCIPL's Services. Users should look at these terms regularly. PCIPL will update the date at the start of this section when the terms are modified.
Changes to these terms will not apply retroactively and will become effective no sooner than 28 days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If Users do not agree to the modified terms for a Service, Users should discontinue use of all Services.
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The laws of Union Republic of India will apply to any disputes arising out of or relating to these terms or PCIPL's Services.
Trade Calls Services:
Cancellation/Refund Policy:
All sales are final and there will be ABSOLUTELY NO REFUNDS and CANCELLATIONS.
In case the client wants to unsubscribe to our Trade Calls services he/she needs to communicate the same to us by writing to us at fx@karvy.com. There will not be any refund, however, after cancellation of our Trade Calls services.
Delivery policy:
Once the client subscribes to our Trade Calls services, the client will start receiving the Trade Calls after telephonic interaction with our representative.
Thus by making the payment, the client agrees and acknowledges to all the terms and conditions of Phillip Capital (India) Pvt. Ltd.
Disclaimer:
We do not receive any consideration by way of remuneration or compensation or in any other form whatsoever, by us or any of our associates or subsidiaries for any distribution or execution services in respect of the products or securities for which the investment advice is provided to the client.
We do not recommend a stock broker. If any stock broker is recommended by any of our representative, we do not receive any consideration by way of remuneration or compensation or in any other form whatsoever from stock broker or any other intermediary so recommended to client.
To ensure compliance with the Investment Advisor regulations 2013, we have resolved that the investment adviser and all its representatives will not make any trades in the market. We are not associated in any manner with any issuer of products/ securities, this ensures that there is no actual or potential conflicts of interest. This also ensures that objectivity or independence in the carrying on of investment advisory services is not compromised. Investment is stock or commodity markets is subject to market risk, though best attempts are made for predicting markets, but no surety of return or accuracy of any kind is guaranteed, while the performance sheet of various products is available but should not be considered as a guarantee for future performance of the products/services. Clients are advised to consider all the advice as just an opinion and make investment decision on their own.
In case of clients seeking advice on any specific positions already made by the client, we will be able to suggest best possible action considering our view on the security or product. Such suggestion under any circumstances shall be considered as an opinion (not advice) from our organization and we advice client to consider our opinion and not consultancy to make his/her final decision. We are not liable for any losses whatsoever client may incur in accepting this opinion.
Client is also advised to trade only if Trade Calls suit his current risk appetite and risk bearing capacity, all such Trade Calls shall be considered as a view or opinion and client shall on his/her discretion decide actual trades.
We are not associated with any intermediaries and do not recommend services of any specific intermediaries. No litigations have been filed against us since the incorporation. All the Trade Calls which are suggested by us are communicated in written, no verbal communication from any of the executives or otherwise under any circumstances shall be considered as advice by our organization.
